  • More Costs.

The mistranslation of a single passage in a contract can lead to lawsuits and more legal fees. There are also cases when companies completely forgo translating contracts. While the initial goal maybe to cut costs, this may actually turn out to be more hurtful to your company’s budget. Take for example the case of Alba Graciano v. Robinson Ford Sales, Inc. in California USA. The state law requires that all contract where one party is a non English speaker must have a translated equivalent into that person’s language. In this case, Graciano bought a car for what he was told was a 0% loan for $12,000. He was able to provide the court with proof of this.

The salesman tried to take advantage of him and increased the price in the contract to $17,865. There was no Spanish translation of the contract. Graciano was awarded $45,000 on damages, plus attorney’s fees – including those used when he appealed the case. In the end, the dealer paid about $300,000 for not following the agreement and not providing contract translations.

  • Rifts between clients and partners.

Inaccurate contract translations can ultimately lead to miscommunication between business partners and even among team members. Job offers or training agreements that have no translated equivalent can lead to a disruptive relationship within the company. Breach of contract can directly lead to a divorce between business partners.

In China, for example, the Shanghai Maritime Court has stated that between 2010 and 2012, errors in translation of contract passages and terms are responsible for starting disputes between Chinese companies and their foreign partners. In 2011 alone, the court heard 1,981 cases. The court claims that contract translations in shipping and navigation laws has caused a dent in the idea that the city is an international hub and a shipping center.
